Legal basis

in the case of consent, Art. 6 para. 1 lit. a EU General Data Protection Regulation (GDPR).

in the case of vital interests of the data subject or another natural person, Art. 6 para. 1 lit. d GDPR.
to safeguard a legitimate interest of our company or a third party, provided that the interests, fundamental rights and freedoms of the data subject do not outweigh the first-mentioned interest, Art. 6 para. 1 lit. f GDPR.
3 Data erasure and storage duration

If the purpose underlying the storage no longer applies, the data subject's personal data will be erased or blocked.

Data may be stored beyond this point in time if this has been provided for by the European or national legislator in EU regulations, laws or other provisions to which the controller is subject. In these cases, the data will be deleted upon expiry of the specified storage period, unless further storage is necessary for the conclusion or fulfilment of a contract.

For example, there may be retention and documentation obligations - such as those arising from the German Commercial Code (HGB) and the German Fiscal Code (AO). The provisions mentioned therein provide for an obligation to retain or document for up to ten years beyond the end of the business relationship or the pre-contractual legal relationship.

Furthermore, there are also statutory provisions that may require a longer retention period, such as the preservation of evidence within the scope of statutory limitation periods. The regular limitation period within the meaning of the German Civil Code (BGB), Sections 195 et seq. is three years - however, limitation periods of up to 30 years may also be applicable.
